Terms & Conditions

On the basis of these General Terms and Conditions (GTC), the contract is concluded between the customer and

hereinafter referred to as the provider.

1) Subject of the contract

This contract regulates the sale of services in the field of courses and riding training via the online shop https://racetrck.de of the provider. For details of the respective offer, reference is made to the product description on the offer page.

2) Conclusion of contract

The contract is concluded in electronic commerce via the shop system or via other means of distance communication such as telephone and email. The offers displayed constitute a non-binding invitation to submit an offer by the customer, which the provider can then accept.

The ordering process for concluding the contract in the shop system comprises the following steps:

  • Selection of the offer in the desired specification (training unit, quantity, date)
  • Adding the offer to the shopping cart
  • Clicking the “book” button
  • Entering the billing and delivery address
  • Selecting the payment method
  • Reviewing and processing the order and all entries
  • Clicking the “order with obligation to pay” button
  • Confirmation email that the order has been received

In addition to the shop system, orders can also be placed via means of distance communication (0162 7821269), whereby the ordering process for concluding the contract comprises the following steps:

  • Telephone call
  • Confirmation email that the order has been received

The contract is concluded upon sending the order confirmation.

For participants under 18 years of age, the declaration of consent of the legal guardian(s) must be attached.

3) Registration and procedure of trainings & courses

3.1 Registration for the training

After confirmation of the entry for an event, the participation fee becomes due immediately or in accordance with the confirmation letter. The liability disclaimer must be signed no later than before the start of the training. Otherwise, participation in the training is not possible.

A minimum number of 5 participants applies to the lean angle training. If this minimum number of participants is not reached, the organizer may cancel the training. The same applies if the lessor of the training site does not make the training area available. In this case, at the provider's choice, an alternative date will be named or the participation fee will be refunded. Further reimbursements (hotel, travel costs, etc.) are excluded.

3.2 Procedure of the lean angle training

The lean angle training starts punctually at the location specified in the registration confirmation. The training may be scheduled earlier – especially in hot weather. If this is the case, the organizer will inform the training participants in advance.

Participation in the training requires that the participant wears adequate protective clothing. This must consist at least of:

  • a protective helmet approved for road traffic and in undamaged condition,
  • motorcycle leather clothing (preferably with protectors; textile clothing is possible),
  • motorcycle protective gloves,
  • motorcycle boots,
  • back protector.

Participants who wish to practice the “hanging-off riding style” during the lean angle training must wear clothing to which knee sliders are attached or can be attached. However, bringing knee sliders is not a prerequisite for participating in the training.

After a theoretical briefing, each participant in the lean angle and combination training gets the opportunity, alternating with the other participants, to use the motorcycle provided for skill riding. It is not about achieving maximum speed. Costs for fuel and other operating materials of the motorcycle are included in the participation fee. Use is at your own risk. In particular, no liability is assumed for damage to the participant's clothing/equipment.

Due to the physical exertion that can result from participating in the training, it is recommended not to travel back on the same evening if you have a longer journey, especially not by motorcycle. Any overnight costs are borne by the participant.

In bad weather (rain), the training generally takes place. If the training cannot take place due to extreme weather conditions (storms, hail) that make riding impossible, each participant will be offered an alternative date at the provider's choice or the registration fee will be refunded. Additional travel costs and other expenses will not be reimbursed.

The organizer provides a special motorcycle for the lean angle training. The participant undertakes to treat the vehicle with care and to use it exclusively for the purpose intended by the training. The training motorcycle may only be put into operation on the instructions of the trainer. The trainer's instructions must always be followed. With registration, the participant declares that, in his or her assessment, he or she is physically and health-wise capable of meeting the requirements placed on him or her by the training and, in particular, is able to safely move a motorcycle. Each participant is responsible for their own riding style. Changes to the training procedure remain reserved.

3.3 Special conditions for pitbike events

Pitbikes belong to the category of fun and racing sports equipment. They are not approved for operation on public roads and may only be operated on suitable grounds or tracks.

Unless otherwise described, the pitbikes are delivered as a kit in the manufacturer's original packaging. In accordance with legal provisions, there is no warranty on the pitbikes.

It is the buyer's responsibility to carry out the final assembly properly or have it carried out. The buyer also bears responsibility for the expert inspection after final assembly. In the case of self-assembly, any claim to warranty is forfeited. On request, the pitbikes can also be handed over already assembled and checked. Before using the pitbikes, they must be checked for functionality.

We exclude liability for accidents during the operation of the pitbikes. Likewise, no liability is assumed for the use of spare parts or on components.

Each participant is obliged to wear the usual protective clothing for motorcycling. This includes in particular: full-face helmet, back protector, leather suit with protectors (two-piece suits must be connected by means of a zipper), motorcycle boots overlapping the motorcycle trousers, motorcycle gloves overlapping the arms of the motorcycle suit.

The participant expressly waives claims for damages of any kind arising in connection with participation in the event, namely against the organizer, its employees as well as against the track operator and its employees. This does not apply to damages resulting from injury to life, body or health caused by an intentional or grossly negligent breach of duty by the organizer or the track operator – including their legal representatives or vicarious agents. The participant is responsible for adequate insurance cover.

4) Waiver of liability & deductible

4.1 Waiver of liability

The event participants (riders, accompanying persons) take part in the event at their own risk. They bear sole civil and criminal responsibility for all damage caused by them or the vehicle they use. By submitting the declaration, the event participants declare the waiver of claims of any kind for damage arising in connection with the event, namely against the organizer, the track operator, their agents, helpers, other participants and other persons connected with the event, insofar as the damage is not based on intent or gross negligence. The waiver also extends to any claims of the participant or third parties against persons entitled or obliged to maintenance. This agreement becomes effective towards all parties involved upon submission of the entry to the organizer.

Excluded are claims for damages by the customer due to injury to life, body, health or essential contractual obligations which must necessarily be fulfilled to achieve the purpose of the contract.

4.2 Deductible

With registration for the lean angle training and/or a pitbike event, the participant agrees to compensate for damage culpably caused by him or her to training equipment (motorcycle, accessories, attachments, other training equipment) up to an amount of €2,500.00.

5) Withdrawal, cancellation and rebooking

The cancellation of an event must be addressed to the provider in writing by email, fax or letter.

  • Up to 90 days before the event: 20% cancellation fee (maximum €35).
  • Up to 30 days before the event: 30% cancellation fee (maximum €70).
  • Up to 15 days before the event: 50% of the entry fee.
  • Less than 15 days before the start of the event: No refund of the entry fee.

Cancellation fees also apply if the event has not yet been paid for.

The cancelling participant can name a replacement rider who must register bindingly. In this case, the cancellation is free of charge for the cancelling participant even within the aforementioned periods.

Naming a replacement rider:
A replacement rider can be named up to 24 hours before the start of the event. The nomination must be made in writing by email to info@racetrck.de stating: first and last name, address, date of birth and email address. Any insurance benefits cannot be transferred to the replacement rider. The costs for the rebooking amount to €25.

6) Exclusion from the event

In the event of participants misjudging their ability to control the motorcycle, the organizer is entitled to exclude the participant from the training. The participation fee will be refunded in this case. Further expenses will not be covered.

The organizer is entitled to exclude participants who endanger or could endanger others through their behavior or repeatedly fail to follow the instructions of the organizer's staff from the training without refund of the training fee or expenses.

7) Image and sound recordings

The participants agree that the provider produces and publishes image and sound recordings of the event for its own advertising purposes. If the participant does not agree, he or she declares this in good time before the start of the event.

8) Conditions for the purchase of vehicles and products

8.1 Scope

These GTC apply to all goods and services offered by us via the website https://racetrck.de and otherwise. They apply both to consumers (§ 13 BGB) and to entrepreneurs (§ 14 BGB). Deviating regulations of the customer are expressly objected to.

8.2 Conclusion of contract for goods

The goods and services shown (e.g. rental) constitute binding offers, unless the goods are individualized according to customer wishes. The contract is concluded online by clicking the “order with obligation to pay” button.

We are entitled to withdraw from the contract if we do not receive the ordered item from our supplier through no fault of our own. In this case, consideration already provided will be refunded immediately.

Goods ordered according to customer specifications, custom-made items and racing sports articles are excluded from return! The online right of withdrawal does not apply to orders placed directly in our store.

8.3 Delivery conditions & shipping

Delivery is made to the delivery address specified by the buyer. If the customer is an entrepreneur, the risk passes upon handover to the shipping company.

The standard delivery time for fully assembled pitbikes is 3–5 weeks, otherwise usually 5 days from receipt of payment.

Vehicles are delivered by shipping company “free curb side”. The customer must ensure that delivery to the address is possible. Customers who refuse acceptance or do not collect the package bear the costs of return processing and re-storage.

8.4 Transport damage

If goods are delivered with obvious transport damage, this must be reported immediately to the deliverer and contact must be made with us. Freight damage must be reported to us and the parcel service no later than within 1 week of receipt of the goods.

8.5 Retention of title

We retain ownership of the purchased item until full payment of the purchase price. For entrepreneurs, this applies until all claims arising from the business relationship are fulfilled.

8.6 Warranty & special features for racing sports articles

The statutory warranty rights apply unless otherwise regulated below. For entrepreneurs, the warranty period is limited to one year.

Important note: There is neither guarantee nor warranty on parts used in racing as well as ECU tuning. Parts without TÜV certificate or ABE are not approved for use on public roads.

Pitbikes are racing vehicles without road approval that are subject to heavy use. The customer is obliged to check the vehicle for functionality upon acceptance. Complaints after acceptance are generally not recognized.

9) Prices and payment conditions

All stated prices are final prices and include the statutory VAT. The following options are available for payment:

  • Advance transfer: The invoice amount must be transferred without deduction to the specified account within 14 days of receipt of the invoice. The goods will only be shipped after receipt of payment.
  • Payment service provider (Stripe): Processing via the Stripe platform in accordance with its terms of use (https://stripe.com).
  • Cash payment: Only possible on personal collection on site.

10) Contract design & correction options

The contract text is stored after the contract is concluded, but is not directly accessible online for the customer. You can inform us of errors in the entries during the ordering process by phone at 0162 7821269 or by email to info@racetrck.de so that we can correct them.

11) Applicable law, place of jurisdiction & language

The contract is drafted in German. The law of the Federal Republic of Germany applies exclusively. If the customer is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the place of jurisdiction is our registered office.

12) Data protection

You will find detailed information on the collection, processing and storage of your personal data in our separate privacy policy.

13) Severability clause

Should any provision of these GTC be or become ineffective, the effectiveness of the remaining provisions shall remain unaffected.

14) Alternative dispute resolution

Information pursuant to § 36 VSBG: We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
